dc.descriptionThis paper aims to analyze the application of the principle of insignificance in the scope of Military Criminal Law, especially in light of the jurisprudence of the Federal Supreme Court (STF) and the Superior Military Court (STM). The principle, also known as bagatelle, aims to eliminate the criminal typicality of conducts that, although formally typical, do not present significant harm to the protected legal asset. However, its application in cases involving the Military Justice is subject to controversy, in view of the specific values protected by the military order, such as hierarchy and discipline. The research, of a qualitative nature and with a deductive method, is based on doctrines, pertinent legislation and the critical analysis of judicial decisions. It is concluded that, although there is resistance on the part of the STM to the adoption of the principle in certain military crimes, the STF has recognized its applicability in specific cases, especially when there is no real threat to the military structure. The tension between the protection of the military order and the adoption of a minimum Criminal Law is the central point of this discussion.pt_BR
dc.description.abstractO presente trabalho tem como objetivo analisar a aplicação do princípio da insignificância no âmbito do Direito Penal Militar, especialmente à luz das jurisprudências do Supremo Tribunal Federal (STF) e do Superior Tribunal Militar (STM). O princípio, também conhecido como bagatela, tem por finalidade afastar a tipicidade penal de condutas que, embora formalmente típicas, não apresentam lesividade significativa ao bem jurídico tutelado. No entanto, sua aplicação em casos envolvendo a Justiça Militar é objeto de controvérsia, tendo em vista os valores específicos protegidos pelo ordenamento militar, como a hierarquia e a disciplina. A pesquisa, de cunho qualitativo e com método dedutivo, baseia-se em doutrinas, legislações pertinentes e na análise crítica de decisões judiciais. Conclui-se que, embora haja resistência por parte do STM à adoção do princípio em certos delitos militares, o STF tem reconhecido sua aplicabilidade em casos específicos, especialmente quando não há ameaça real à estrutura militar. A tensão entre a proteção da ordem militar e a adoção de um Direito Penal mínimo é o ponto central dessa discussão.pt_BR
