| Resumo: | Este trabalho tem como objetivo analisar a inconstitucionalidade material do mínimo existencial fixado em R$ 600,00 pelo Decreto Federal nº 11.150/2022 e avaliar sua efetividade sob a ótica das ações de superendividamento no Tribunal de Justiça do Maranhão. Para tanto, utiliza-se abordagem quantitativa, com pesquisa bibliográfica, documental e empírica, esta última mediante análise de jurimetria de 1.500 processos do TJMA. Os resultados evidenciam que a fixação de valor estático e uniforme desconsidera as disparidades regionais e o custo real de vida, notadamente no Maranhão, onde 83,10% das liminares foram indeferidas e apenas 17,25% das sentenças reconheceram o superendividamento. A pesquisa demonstra ainda que a interpretação literal do decreto pelos magistrados converte o mínimo existencial em parâmetro puramente aritmético, excluindo sistematicamente os consumidores da proteção prevista na Lei Federal nº 14.181/2021. Conclui-se que o valor de R$ 600,00 é materialmente inconstitucional por ser insuficiente para garantir condições mínimas de subsistência digna, gerando insegurança jurídica e inviabilizando a efetividade da repactuação de dívidas, sendo imperativa a adoção de interpretação relativa e contextualizada do instituto. |
| Descrição: | This study aims to analyze the substantive unconstitutionality of the "existential minimum" set at R$ 600.00 by Federal Decree No. 11.150/2022 and to evaluate its effectiveness regarding over-indebtedness lawsuits before the Court of Justice of Maranhão (TJMA). To this end, a quantitative approach is employed, utilizing bibliographic, documentary, and empirical research—the latter involving a jurimetric analysis of 1,500 TJMA cases. The results reveal that establishing a static, uniform amount disregards regional disparities and the actual cost of living, particularly in Maranhão, where 83.10% of preliminary injunctions were denied and only 17,25% of judgments recognized over-indebtedness. The research further demonstrates that a literal interpretation of the decree by magistrates transforms the existential minimum into a purely arithmetic parameter, systematically excluding consumers from the protections provided by Federal Law No. 14.181/2021. It is concluded that the R$ 600.00 figure is substantively unconstitutional, as it is insufficient to guarantee the minimum conditions for a dignified livelihood; this creates legal uncertainty and undermines the effectiveness of debt renegotiation, making the adoption of a relative and contextualized interpretation of the concept imperative. |
