| Resumo: | Este trabalho tem como objetivo analisar juridicamente a adequação do ordenamento jurídico brasileiro ao Acordo TRIPS (Trade-Related Aspects of Intellectual Property Rights), firmado no âmbito da Organização Mundial do Comércio (OMC), com foco na proteção da propriedade intelectual. A metodologia utilizada foi a pesquisa bibliográfica, documental e jurisprudencial, com enfoque qualitativo e caráter monográfico. A pesquisa percorre a evolução histórica das convenções internacionais sobre o tema e destaca as inovações introduzidas pelo TRIPS, tais como a harmonização de normas, a criação de padrões mínimos obrigatórios e mecanismos de solução de controvérsias. Em seguida, investiga-se como o Brasil incorporou tais diretrizes em seu ordenamento jurídico, por meio da promulgação de leis como a Lei n.º 9.279/1996, além de outros dispositivos. Por fim, realiza-se uma análise crítica do instituto das patentes pipeline e das controvérsias constitucionais suscitadas, com destaque para a Ação Direta de Inconstitucionalidade n.º 4.234. Conclui-se que, embora o Brasil tenha se esforçado para atender aos compromissos internacionais assumidos, ainda existem desafios jurídicos e sociais para a aplicação equitativa e eficaz das normas de propriedade intelectual, sobretudo na proteção da saúde pública e no respeito aos princípios constitucionais internos. |
| Descrição: | This paper aims to legally analyze the adaptation of the Brazilian legal system to the TRIPS Agreement (Trade-Related Aspects of Intellectual Property Rights), established under the World Trade Organization (WTO), focusing on the protection of intellectual property. The methodology employed was bibliographic, documentary, and jurisprudential research, with a qualitative approach and monographic character. The research traces the historical evolution of international conventions on the subject and highlights the innovations introduced by TRIPS, including the harmonization of rules, the establishment of minimum mandatory standards, and the creation of dispute resolution mechanisms. The study then investigates how Brazil incorporated these directives into its legal framework, especially through the enactment of Law No. 9.279/1996, along with provisions related to patents, trademarks, copyrights, and trade secrets. Finally, the paper provides a critical analysis of the pipeline patent mechanism and the constitutional controversies it raises, especially through the Direct Action of Unconstitutionality No. 4.234. It concludes that, although Brazil has made significant efforts to meet its international commitments, there are still legal and social challenges in ensuring the fair and effective application of intellectual property rules, particularly in protecting public health and respecting national constitutional principles. |
