| dc.description | This study analyzes the incompatibility of the Non-Prosecution Agreement (ANPP), as provided in Article 28-A of the Brazilian Code of Criminal Procedure, with digital child pornography crimes, which are criminalized under Articles 241-A and 241-B of the Child and Adolescent Statute (ECA). The objective of this research is to demonstrate that, although these criminal offenses may formally satisfy certain objective requirements of this plea-bargaining-like instrument, concluding such an agreement is incompatible with the constitutional system of integral protection for children and adolescents. Adopting a qualitative methodology, this study employs a bibliographic and documentary approach, grounded in the analysis of legislation, legal doctrine, jurisprudence, and decisions rendered by the Federal Public Prosecutor's Office. Initially, the study examines the principle of integral protection enshrined in Article 227 of the 1988 Federal Constitution and the legal interests protected by the ECA, encompassing sexual dignity, integral development, and the collective interest in eradicating the sexual exploitation of minors. Subsequently, it analyzes the legal nature and requirements of the ANPP, emphasizing the criterion of 'sufficiency for the reprobation and prevention of crime' as an opening clause for the principle of the prohibition of insufficient protection (Untermassverbot). Drawing on the theoretical framework of integral penal guarantism, which recognizes the State's dual constitutional obligation—both the prohibition of excess and the prohibition of insufficient protection—it is argued that the ANPP represents an inadequate response to these crimes. It fails to satisfy the constitutional mandate for severe punishment set forth in Article 227, § 4, of the Federal Constitution, as well as the obligations arising from international treaties ratified by Brazil. The study concludes that, whether due to an implicit constitutional and conventional prohibition or through a binding interpretative criterion, the ANPP is neither necessary nor sufficient for the reprobation and prevention of digital child pornography crimes, and thus should be refused by the Public Prosecutor's Office and denied homologation by the Judiciary. | pt_BR |
| dc.description.abstract | O presente trabalho analisa a incompatibilidade da propositura do Acordo de Não Persecução Penal (ANPP), previsto no artigo 28-A do Código de Processo Penal, aos crimes de pornografia infantil praticados por meio digital, tipificados nos artigos 241-A e 241-B do Estatuto da Criança e do Adolescente (ECA). O presente estudo tem o intuito de demonstrar que, embora os referidos tipos penais satisfaçam formalmente alguns requisitos objetivos do instituto negocial, a celebração do acordo é incompatível com o sistema constitucional de proteção integral à criança e ao adolescente. Adota-se a metodologia qualitativa, com abordagem bibliográfica e documental, fundamentando-se na análise de legislação, doutrina e jurisprudência e decisões apreciados pelo Ministério Público Federal. Incialmente, o estudo parte do exame do princípio da proteção integral consagrado no artigo 227 da Constituição Federal de 1988 e do bem jurídico tutelado pelo ECA, compreendendo a dignidade sexual, o desenvolvimento integral e o interesse coletivo na erradicação da exploração sexual infanto-juvenil. Em seguida, analisa a natureza jurídica e os requisitos do ANPP, com ênfase no critério de suficiência para reprovação e prevenção do crime como cláusula de abertura ao princípio da proibição de proteção insuficiente, o Untermassverbot. A partir do referencial teórico do garantismo penal integral, que reconhece o duplo vínculo constitucional do Estado, tanto a proibição de excesso quanto a proibição de proteção insuficiente, verifica-se que o ANPP representa resposta inadequada aos crimes em questão, por não satisfazer o mandado constitucional de punição severa previsto na redação do artigo 227, § 4º, da Constituição Federal, nem as obrigações decorrentes dos tratados internacionais ratificados pelo Brasil. Conclui-se que, seja por vedação implícita de ordem constitucional e convencional, seja por critério interpretativo vinculante, o ANPP não se mostra necessário nem suficiente para a reprovação e prevenção dos crimes de pornografia infantil por meio digital, devendo ser recusado pelo Ministério Público e não homologado pelo Poder Judiciário. | pt_BR |
