Resumo: O presente trabalho analisa os impactos do uso da inteligência artificial na prestação jurisdicional, a partir de um estudo de caso do Tribunal de Justiça do Estado do Maranhão, em especial o ToadaLAb – Laboratório de Inovação do Tribunal de Justiça do Estado do Maranhão. A pesquisa investiga de que forma o uso de ferramentas de IA no TJMA, no ano de 2025, impacta a eficiência da prestação jurisdicional e quais os riscos de comprometimento das garantias fundamentais do processo. Parte-se da compreensão de que a incorporação de sistemas de IA ao Poder Judiciário constitui uma transformação relevante do Direito contemporâneo, com potencial de promover ganhos de eficiência administrativa e racionalização processual, mas também de apresentar riscos à proteção de direitos e garantias fundamentais do processo. A pesquisa adota abordagem qualitativa, de natureza exploratória e descritiva, com método indutivo e estudo de caso institucional, utilizando as técnicas de pesquisa bibliográfica e documental. O referencial teórico articula obras doutrinárias sobre inteligência artificial e direito processual com o marco normativo do Conselho Nacional de Justiça, em especial as Resoluções n. 332/2020 e n. 615/2025. A análise das iniciativas do TJMA, incluindo a integração do Gemini Enterprise, o projeto-piloto “Simplifica AI” e o programa de formação em IA da ESMAM, revela avanços nas dimensões da eficiência e da capacitação institucional, e lacunas nas dimensões da transparência algorítmica e dos mecanismos de controle e supervisão humana. Conclui-se que as iniciativas identificadas confirmam a hipótese da pesquisa, evidenciando que o uso de IA no TJMA ainda não é plenamente acompanhado pelos mecanismos de governança exigidos pelo Estado Democrático de Direito e pela Resolução CNJ n. 615/2025.
Descrição: This study analyzes the impacts of the use of artificial intelligence on judicial adjudication through a case study of the Court of Justice of the State of Maranhão (TJMA), with particular emphasis on ToadaLAb – the Innovation Laboratory of the Court of Justice of the State of Maranhão. The research investigates how the use of AI tools within TJMA in 2025 affects the efficiency of judicial services and the potential risks to fundamental procedural guarantees. It is based on the understanding that the incorporation of AI systems into the Judiciary constitutes a significant transformation in contemporary law, with the potential to enhance administrative efficiency and procedural rationalization, while also presenting risks to the protection of rights and fundamental procedural guarantees. The study adopts a qualitative, exploratory, and descriptive approach, employing a deductive method and an institutional case study, supported by bibliographic and documentary research techniques. The theoretical framework combines doctrinal works on artificial intelligence and procedural law with the regulatory framework established by the National Council of Justice (CNJ), particularly Resolutions No. 332/2020 and No. 615/2025. The analysis of TJMA’s initiatives, including the integration of Gemini Enterprise, the “Simplifica AI” pilot project, and ESMAM’s AI training program, reveals progress in the areas of efficiency and institutional capacity-building, as well as shortcomings regarding algorithmic transparency and mechanisms for human oversight and supervision. The study concludes that the identified initiatives confirm the research hypothesis, demonstrating that the use of AI within TJMA is not yet fully accompanied by the governance mechanisms required by the Democratic Rule of Law and CNJ Resolution No. 615/2025.
