| Resumo: | RESUMO Este trabalho procurou estudar os entendimentos, legislações, ações e omissões do Governo Brasileiro na execução dos contratos com garantia de alienação fiduciária no contexto de pandemia do coronavírus. Assim, com o fito de entender as questões envolvidas no debate, objetiva o presente trabalho, a análise da efetividade e papel dessas ações e providências tomadas pelo Estado, cuja estrutura metodológica se deu mediante pesquisa de literatura e legislação especializada no tema e apreciação de jurisprudências nacionais. A obra foi dividida em três seções, uma primeira que apresenta a alienação fiduciária em garantia e suas características, a segunda é dedicada a abordar os impactos da pandemia do coronavírus na economia e relações contratuais, com a última seção, por fim, expondo e analisando os entendimentos, legislações, ações e omissões dos Poderes Públicos durante o contexto de crise nacional. No primeiro capítulo do desenvolvimento, o presente trabalho busca apresentar a alienação fiduciária em garantia e suas características. No capítulo adiante, o foco da análise reside nos impactos da pandemia do coronavírus na economia e relações contratuais, sobretudo nos contratos com garantia de alienação fiduciária. No terceiro e último capítulo do desenvolvimento, buscou-se expor e analisar os entendimentos, legislações, ações e omissões dos Poderes Públicos durante o contexto de crise nacional. |
| Descrição: | ABSTRACT This work sought to study the understandings, legislation, actions and omissions of the Brazilian Government in the execution of contracts with a guarantee of fiduciary alienation in the context of the coronavirus pandemic. Thus, in order to understand the issues involved in the debate, the objective of this work is the analysis of the effectiveness and role of these actions and measures taken by the State, whose methodological structure was through literature research and specialized legislation on the subject and appreciation of national jurisprudence. The work was divided into three sections, a first that presents the fiduciary alienation in guarantee and its characteristics, the second is dedicated to addressing the impacts of the coronavirus pandemic on the economy and contractual relations, with the last section, finally, exposing and analyzing the understandings, legislation, actions and omissions of the Public Powers during the context of national crisis. In the first chapter of the development, this work seeks to present the fiduciary alienation in guarantee and its characteristics. In the chapter below, the focus of the analysis lies on the impacts of the coronavirus pandemic on the economy and contractual relations, especially in contracts with a guarantee of fiduciary disposal. In the third and last chapter of the development, we sought to expose and analyze the understandings, legislations, actions and omissions of the Public Powers during the context of national crisis. |
