| Resumo: | O presente trabalho tem como objetivo analisar o julgamento da Ação Direta de Inconstitucionalidade por Omissão n.º 55 à luz da teoria do controle judicial das omissões constitucionais, buscando verificar se há tendência de ampliação dos efeitos concretos das decisões do Supremo Tribunal Federal nesse tipo de ação. A pesquisa possui natureza exploratória, adotando o método dedutivo como método de abordagem e o método monográfico como método de procedimento. Quanto aos procedimentos técnicos, foram realizadas pesquisas bibliográfica e documental, fundamentadas na análise da Constituição Federal de 1988, de obras doutrinárias, artigos científicos, projetos de lei referentes ao Imposto sobre Grandes Fortunas (IGF), bem como dos votos, acórdãos e decisões proferidos pelo Supremo Tribunal Federal. Inicialmente, examinou-se o conceito, a natureza jurídica e os principais aspectos relacionados ao IGF no ordenamento brasileiro. Em seguida, analisou-se a Ação Direta de Inconstitucionalidade por Omissão como instrumento de controle concentrado de constitucionalidade e a evolução da jurisprudência do STF em matéria de omissão legislativa. Os resultados demonstraram que a Corte tem desenvolvido mecanismos destinados a conferir maior efetividade às normas constitucionais em determinadas situações de inércia legislativa, especialmente quando estão envolvidos direitos fundamentais, a exemplo dos precedentes relativos ao direito de greve dos servidores públicos e à criminalização da homofobia e da transfobia. Entretanto, a análise da ADO 55 evidenciou que, embora o STF tenha reconhecido a existência da omissão legislativa quanto à regulamentação do IGF, optou por não atribuir efeitos concretos e vinculantes semelhantes aos observados nesses precedentes, em razão das particularidades da matéria tributária e dos limites impostos pelos princípios da legalidade tributária, da reserva de lei e da separação dos poderes. Conclui-se que a decisão proferida na ADO 55 reafirma a preocupação com a efetividade da Constituição, mas demonstra que a ampliação dos efeitos das decisões em casos de omissão legislativa não constitui uma tendência absoluta da jurisprudência do STF, dependendo das especificidades da matéria submetida à apreciação da Corte. |
| Descrição: | This study aims to analyze the judgment of Direct Action for Unconstitutionality by Omission No. 55 (ADO 55) in light of the theory of judicial review of constitutional omissions, seeking to determine whether there is a tendency toward expanding the concrete effects of decisions rendered by the Supreme Federal Court in this type of proceeding. The research is exploratory in nature and adopts the deductive method as its approach and the monographic method as its procedure. Regarding technical procedures, bibliographic and documentary research was conducted based on the analysis of the 1988 Federal Constitution, doctrinal works, scientific articles, legislative bills concerning the Tax on Large Fortunes (IGF), as well as the votes, judgments, and decisions issued by the Supreme Federal Court. Initially, the concept, legal nature, and main aspects of the IGF within the Brazilian legal system were examined. Subsequently, the Direct Action for Unconstitutionality by Omission was analyzed as an instrument of centralized constitutional review, together with the evolution of the Supreme Federal Court's case law concerning legislative omissions. The findings demonstrated that the Court has developed mechanisms aimed at ensuring greater effectiveness of constitutional norms in situations of legislative inertia, particularly when fundamental rights are at stake, as evidenced by the precedents concerning the right to strike of public servants and the criminalization of homophobia and transphobia. However, the analysis of ADO 55 revealed that, although the Court recognized the existence of a legislative omission regarding the regulation of the IGF, it chose not to attribute concrete and binding effects similar to those adopted in those precedents, due to the particularities of tax matters and the limits imposed by the principles of tax legality, statutory reservation, and separation of powers. It is concluded that the decision rendered in ADO 55 reaffirms the concern with the effectiveness of the Constitution, while demonstrating that the expansion of the effects of judicial decisions in cases of legislative omission does not constitute an absolute trend in the Court's jurisprudence, but rather depends on the specific characteristics of the matter submitted to judicial review. |
